Can you legally consume on site in Delaware?

Practically, a visitor's only lawful option is a private residence or a rental/hotel room where the owner explicitly permits smoking or vaping, so confirm the property's cannabis policy in writing before you book; edibles and low-odor options are the safer choice. Also note home growing is completely illegal in Delaware, and driving under the influence is aggressively enforced along the I-95 and Route 1 beach corridors.
What changed recently
Adult-use retail sales began August 1, 2025, launched by existing medical compassion centers that converted to dual medical/adult-use operation after Gov. Meyer signed legislation expediting the launch; Joshua Sanderlin was appointed Marijuana Commissioner in April 2025. Sales have run well below projections (~$29.3M from Aug 2025 through Feb 2026 vs. ~$281M annual forecast). Pending: HS 1 for HB 252 (Rep. Morrison) would reclassify public consumption from an unclassified misdemeanor to a civil violation ($50 first offense, $100 thereafter, with jail eliminated); it cleared committee 9-5 in January 2026 and was on the Ready List as of March 10, 2026 but had not been enacted as of July 2026. A separate bill regulating THC-infused beverages (off-premises sale only) went to the Governor in July 2026. No lounge/on-site consumption legislation is pending.
