Cannabis in New York: lounges, dispensaries & laws

In New York, recreational and medical cannabis are legal (legalized in 2021). Adult possession is capped at adults 21+ may possess up to 3 ounces of cannabis flower and up to 24 grams of concentrated cannabis in public (NY Penal Law 222.05). Separately, up to 5 pounds of cannabis may be lawfully possessed inside a private residence if it is home-grown and stored in a secured location inaccessible to anyone under 21 (Penal Law 222.15). No separate statutory edible sublimit — edibles count toward the flower/concentrate caps by product type.

Can you legally consume on site in New York?

Authorized — none open yet

Legal on paper, but not yet available. Cannabis Law Section 77 ('Adult-use on-site consumption license') expressly authorizes licensed consumption venues, and the MRTA has contemplated them since 2021. However, the Office of Cannabis Management has never opened an application window for the license. OCM's own licensing materials state that 'future application windows for licenses such as nursery, delivery, cooperative or collective, and on-site consumption are anticipated' — meaning no on-site consumption licenses had been issued and no state-licensed lounge was legally operating in New York as of July 2026. Municipalities that opted out of on-site consumption licenses before the December 31, 2021 deadline (a separate opt-out from the retail dispensary opt-out) will remain off-limits even once licensing opens; New York City did not opt out. Pending bills S5826 / A747 (2025-2026 session, in Senate Investigations and Government Operations Committee as of January 7, 2026) would let future on-site consumption licensees also sell non-infused food, non-alcoholic beverages, and ticketed live performances — but the bill has not passed either chamber. Note: numerous unlicensed 'consumption lounges,' members-only clubs, and cannabis-friendly event spaces operate in NYC; these are not state-licensed and are not what the statute authorizes. No legally licensed lounge venue can be named.

Penal Law 222.15: each person 21+ may cultivate up to 3 mature and 3 immature plants (6 total per adult), with a hard cap of 6 mature and 6 immature plants (12 total) per private residence regardless of how many adults live there. Plants must be in a secured location on the residence grounds, inaccessible to under-21s. Registered medical patients (and their caregivers) have had home cultivation rights in effect since October 2022 under the same 3 mature / 3 immature per-person, 6/6 per-household structure, and may possess up to 5 pounds of their harvest. Note: MRTA conditioned adult-use (non-patient) home grow on the Cannabis Control Board adopting implementing regulations; the statutory limits above are on the books, but whether the adult-use home-grow regulations are fully in effect as of July 2026 was not confirmable from OCM pages in this pass — verify with the Office of Cannabis Management.
Public consumption
New York is unusually permissive: cannabis may be smoked or vaped anywhere tobacco smoking is legal. Penal Law 222.10 prohibits smoking cannabis only where Public Health Law Article 13-E bans smoking (indoor workplaces, bars, restaurants, mass transit, within 100 feet of school entrances, hospital grounds, etc.) and on school grounds or school buses. Violation is a civil offense with a fine of up to $25 or up to 20 hours of community service — not a criminal charge. Consuming in a motor vehicle, and any use in a vehicle on a public highway, remains prohibited. Local smoke-free rules still apply on top: NYC bans smoking in all city parks, beaches, boardwalks and pedestrian plazas, so cannabis smoking is barred there too. The odor of cannabis alone is not probable cause for a search or vehicle stop.

Out-of-state medical cards
Contested / effectively moot. New York does not operate a formal out-of-state patient registration program, and out-of-state medical cards are not honored for purchases at New York medical dispensaries. NORML's state page references reciprocity protections, but this appears to describe legal protection for visiting patients rather than a right to purchase. In practice it does not matter for visitors: anyone 21+ with a valid government photo ID from any state can buy at New York's licensed adult-use dispensaries. The only thing an out-of-state card would gain you is the lower medical tax rate (3.15% vs. the ~13% adult-use rate), which is not available to non-registered visitors. Verify with OCM if the tax distinction matters.
Qualifying conditions
Very broad — effectively unlimited. Since the 2021 MRTA expansion (implemented January 2022), a certifying practitioner may recommend medical cannabis for any condition they believe can be treated with it, rather than being limited to a fixed list. The prior statutory list of roughly 17 conditions (cancer, chronic pain, epilepsy, PTSD, MS, HIV/AIDS, ALS, Parkinson's, neuropathy, etc.) remains as guidance but is no longer a ceiling. As of July 1, 2026 there were about 72,161 registered patients and 4,779 certifying practitioners.

Visiting New York

New York is one of the easiest states in the country for a visiting consumer, because it is one of the very few where smoking cannabis on a public sidewalk or street is legal — cannabis may be consumed anywhere tobacco smoking is permitted, and the penalty for getting it wrong is a civil fine of up to $25, not an arrest. That solves the tourist-with-no-private-residence problem that plagues most legal states. The catch is that the exceptions are the places you'd actually want to be: all NYC parks, beaches, boardwalks and pedestrian plazas (including Central Park, the High Line, and Times Square plazas) ban smoking entirely, as do transit, restaurant patios, bar areas, and anywhere within 100 feet of a school entrance. Nearly all hotels are non-smoking and will bill you a cleaning fee, so plan on the street or a private residence. There are still no state-licensed consumption lounges — venues marketing themselves as NYC 'cannabis lounges' or members-only clubs are operating outside the licensing system — and note that New York has aggressively raided unlicensed storefronts, so buy only from a dispensary you have verified on OCM's official dispensary-location verification tool.

What changed recently

Governor Hochul signed a medical cannabis bill on November 21, 2025 adding patient protections and expanding access to medical cannabis products. Bills S5826 and A747 (2025-2026 session) would let future on-site consumption licensees sell non-infused food, non-alcoholic beverages, and ticketed live performances; S5826 was referred to the Senate Investigations and Government Operations Committee on January 7, 2026 and remains in committee. OCM has introduced Processor Type 3 Branding and Type 3 Flower licenses with year-round applications, and Cannabis Showcase Event (CSE) permits allowing licensed dispensaries to sell at off-site events. OCM continues to signal that an on-site consumption application window is 'anticipated' but has announced no date. Additional pending proposals address THC potency caps, proximity restrictions, and expanded social-equity funding.
