Can you legally consume on site in West Virginia?

Hotels, parks, casinos, state and national forest land, and the New River Gorge area are all off-limits, and the state's interstate corridors (I-64, I-77, I-79) see active drug interdiction stops, so do not transport product in from neighboring Maryland, Ohio, or Virginia where it may be legal — crossing the state line with it is a separate trafficking-exposed offense.
What changed recently
West Virginia's program remains medical-only with no adult-use legalization on the horizon. The notable pending change is HB 5260, an edibles-expansion bill that passed the House in March 2026 to add edible products to the medical program; statute currently bars dispensaries from selling edibles (patients/caregivers may only convert permitted forms into an edible themselves for ingestion). Final enactment and effective date are not confirmed — verify with the Legislature and the Office of Medical Cannabis. Decriminalization and home-cultivation bills continue to be introduced each session without passing.
